1. Welcome to KingWash

These Terms of Use ("Terms") explain how you can access and use the KingWash website, mobile app, and operator portal (together, the KingWash Services). By signing up, logging in, or using KingWash, you agree to these Terms. If you do not agree, please do not use our services.

2. Who We Are

KingWash is operated by King Wash Group Pty Ltd, an Australian company that provides a digital marketplace connecting vehicle owners (users, drivers, and fleet operators) with car wash operators. KingWash acts as a facilitator, not the car wash provider itself.

All wash services are performed by independent operators who manage their own locations and service quality.

3. Who These Terms Apply To

These Terms apply to:

  • Customers/Drivers – individuals or businesses who book and pay for car washes through KingWash.
  • Operators – car wash businesses who join KingWash to promote and deliver wash services.

4. Using KingWash

You must:

  • Be 18 years or older and hold a valid Australian driver's licence;
  • Provide accurate and up-to-date information when creating an account;
  • Use the service for lawful personal or business purposes only;
  • Not attempt to copy, reverse-engineer, or interfere with the platform;
  • Not misuse promotional offers, rewards, or referral systems.

KingWash reserves the right to suspend or terminate accounts that breach these Terms or our Privacy Policy.

4.1 Fair Use Policy

KingWash offers subscription plans that provide customers with convenient and flexible access to participating car wash locations. To ensure all customers receive a fair and consistent experience, KingWash applies a Fair Use Policy.

We monitor usage patterns to identify unreasonable or excessive use that may negatively impact other customers or operators. "Unreasonable use" may include, but is not limited to:

  • Washing multiple vehicles under a single subscription;
  • Washing other people vehicles under a different subscription;
  • Washing the same vehicle more than [1] times per week;
  • Behaviour that places excessive demand on participating operators; or
  • Any use inconsistent with normal personal or commercial vehicle cleaning habits.

Where KingWash reasonably believes your usage breaches this Fair Use Policy, we may contact you to discuss your usage, or suspend, modify or cancel your access or subscription (with or without notice) in accordance with our Terms of Use.

KingWash reserves the right to update this policy at any time to maintain service quality and fairness for all users.

5. Your Account

You're responsible for:

  • Keeping your login details secure;
  • Any activity that occurs under your account;
  • Updating your personal and vehicle information.

6. Payments & Refunds

6.1 Usage

KingWash operates on a prepaid top-up model, allowing customers to set their own wash preferences including the number and type of washes — and receive an estimated cost based on those selections. Customers may use the service up to the value of their active wash balance. Once the balance has been used, customers will need to top up to continue accessing participating wash locations.

To ensure fairness and maintain service quality for all users and operators, KingWash applies a Fair Use Policy. This means:

  • Each account is for personal use only and linked to the registered vehicle(s) within the app;
  • Account sharing, transferring, or using the same account for multiple vehicles is not permitted;
  • Usage that is inconsistent with normal washing patterns, or that places excessive demand on participating operators, may be reviewed.

Where KingWash reasonably believes that a customer's usage breaches this Fair Use Policy, we may contact the customer to discuss their activity or may suspend, limit, or cancel their account in accordance with our Terms of Use.

6.2 Payments

1. Payment Processing

Payments are securely processed via EML (ghost card), Stripe, or other approved third-party payment processors. All pricing is displayed in Australian Dollars (AUD) and includes GST where applicable.

2. Customer Payments

Customers operate on a prepaid top-up basis. Each month, the customer's KingWash account will be credited with their nominated wash budget. Washes can then be purchased at participating locations using the KingWash mobile app via QR code or their issued KingWash card. The cost of each wash will be automatically deducted from the customer's available credit balance at the applicable retail rate.

3. Operator Payments

Operators will be paid a wholesale rate as agreed in their Operator Onboarding Contract. KingWash will remit payments to operators via Electronic Funds Transfer (EFT) on a weekly basis, based on the total number of completed washes processed through the KingWash platform during that period. Payments may be made via EML (ghost card) or EFT, depending on the operator's preferred method of settlement.

4. Service Margin

The difference between the retail rate charged to customers and the wholesale rate paid to operators constitutes KingWash's service margin.

5. Failed or Reversed Transactions

In the event of a failed, reversed, or disputed transaction, KingWash reserves the right to suspend the relevant customer account or deduct the outstanding amount from the customer's next top-up.

6. Refunds and Cancellations

  • Customer Refunds: If a wash fails to start, is incomplete, or is otherwise unsatisfactory due to operator or technical error, the customer may request a refund within 7 days via the KingWash app or by emailing [email protected]. Refunds will be applied as a credit to the customer's KingWash balance unless otherwise required by law.
  • Operator Cancellations: If an operator cancels or is unable to complete a booked wash, no charge will be deducted from the customer's balance.
  • Change of Mind: Credits purchased through the top-up system are non-refundable unless required by Australian Consumer Law (ACL). Customers may cancel their subscription or stop topping up at any time; any remaining balance will remain available until used or until 12 months of inactivity, after which the balance may be forfeited.
  • Legal Rights: Nothing in this clause limits a customer's rights under the Australian Consumer Law (ACL).

6.3 Cancellations & Refunds

  • You may cancel your subscription anytime via the app or by contacting us. Refunds are not generally provided for unused periods, except as required under Australian Consumer Law.
  • If an operator fails to deliver a wash, please contact us — we'll investigate and, if appropriate, credit or refund your account.

7. Operators

7.1 Operator Responsibilities

Operators agree to:

  • Provide accurate details about their business, pricing, and wash quality;
  • Honour bookings made through KingWash;
  • Maintain appropriate insurance and compliance with local regulations;
  • Ensure safe, clean, and lawful operating environments;
  • Notify KingWash promptly of closures, delays, or issues.

Operators acknowledge that customer personal data will not be shared directly with them. All customer communication and marketing is managed by KingWash.

7.2 Operator Fees

Operators may pay fees or commissions to KingWash for participation or marketing. Payment terms are governed by separate onboarding agreements.

8. KingWash's Role

KingWash:

  • Provides the platform and payment facilitation,
  • Does not own or operate any car wash locations,
  • Does not guarantee the performance or outcome of any wash, and
  • Is not liable for any damage, delay, or service failure caused by operators or customers.

However, we'll always help mediate and resolve disputes in good faith.

9. Promotions, Rewards & Communications

We may send you:

  • Service updates, receipts, and reminders;
  • Promotional or marketing offers (from us or on behalf of operators);
  • Loyalty rewards and referral bonuses.

You can opt out of promotional messages at any time via app settings or unsubscribe links.

10. Intellectual Property

All content, trademarks, software, and materials on the KingWash Services belong to King Wash Group Pty Ltd or its licensors.

You may not copy, modify, distribute, or commercially exploit any part of KingWash without written permission.

11. Liability & Disclaimers

To the maximum extent permitted by law:

  • KingWash provides its services "as is";
  • We make no warranties about uninterrupted access or error-free operation;
  • Our total liability for any claim is limited to the amount you paid for the affected transaction or three months of subscription fees, whichever is less.

Nothing in these Terms limits your rights under Australian Consumer Law.

12. Disputes & Complaints

If you have an issue with a wash or operator:

  1. Contact us first at [email protected] so we can help resolve it quickly.
  2. If we can't resolve the issue, you may seek further resolution through your local fair trading office or NSW Civil and Administrative Tribunal (NCAT).

13. Termination

You may stop using KingWash at any time. We may suspend or terminate your account if you breach these Terms or act unlawfully. Termination doesn't affect accrued rights or obligations (e.g. outstanding payments).

14. Updates to These Terms

We may update these Terms occasionally. The latest version will always be posted at www.kingwash.com.au/terms and take effect when published.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be heard in the courts of NSW.
